One-time FBI Employee Alleges Improper Firing Over LGBTQ+ Banner Display

An experienced Federal Bureau of Investigation intelligence specialist has brought a legal case claiming his let go because of displaying an LGBTQ+ banner at his desk area.

Based on the plaintiff, who was employed with the bureau over a decade and a half, the dismissal recently was “illegal and discriminatory”.

The complaint states that the FBI breached the employee’s First Amendment freedoms and engaged in punitive action against him due to expressing constitutionally covered expression.

Maltinsky is requesting a judicial directive to reinstate his employment at the bureau.

The detailed complaint, filed in a Washington court in the nation’s capital, claims that Maltinsky was dismissed from his training recently over earlier displaying the banner at his workstation.

According to the document, the rainbow symbol was presented to the employee in recognition of his efforts to support the FBI’s equality efforts.

Early on, all I have wanted to do is serve the United States and ensure its security together with the talented and committed personnel of the FBI,” remarked Maltinsky.

He continued, I showed that banner – that previously was displayed at the Wilshire federal building – not to make a political point, but rather as an emblem of acceptance, solidarity and impartial service.

“These are the values that helped build the FBI strong. Currently it stands as where individuals such as myself are targeted. I believe I was terminated not due to my identity, but rather because of what I represent: an openly gay individual,” he said.

Sudden Dismissal Prior to Finish

Recently, Maltinsky was enrolled in the bureau’s agent course at Quantico, Virginia, until his “sudden termination just three weeks before completion”.

The filing additionally states that eventually following Donald Trump’s inauguration, an colleague raised an issue to his manager about the display of the Pride flag.

“Out of an abundance of caution, Maltinsky requested that the legal advisor for the local bureau review whether or not the presence of the LGBTQ+ banner was acceptable,” the complaint stated.

Under the Constitution of the United States Constitution, and statutes of the United States, your employment with the Federal Bureau of Investigation is concluded.”

Attorney Comment

In comments released recently, his legal representative his counsel remarked, The government’s unlawfully firing him forms part of an extensive initiative to remove federal agencies of workers with different viewpoints, or belong to marginalized groups, or those who challenge discrimination.

This battle goes beyond his situation, but involves protecting the rights and freedoms of all federal employees.”

The case comes after another one lodged recently by ex- top agency personnel who alleged they’d been improperly dismissed.

They stated that Patel stated he had been ordered by the administration to terminate any official participating in an inquiry concerning Donald Trump.

At the same time, the bureau terminated a nearly three-decade veteran earlier this month following Patel was said to be angered by reports that the FBI director used an official aircraft to go to a wrestling event where his girlfriend rendered the Star-Spangled Banner.

The veteran, an FBI employee since 1998, was removed from his role in the agency’s response team, which manages serious incidents and the agency’s jet fleet.
